
General Terms of Sale
The general conditions of sale apply to any order sent from the website www.philipmartins.it .
 The Customer declares to have read all the information provided during the purchase process and to fully accept the general and payment conditions; he/she also declares to be of legal age and in any case to have the legal capacity to enter into a valid and effective sales contract.
 PHILIP MARTIN'S may modify the content of the GENERAL TERMS AND CONDITIONS set forth in this document at any time and without notice; such modifications will take effect from the date of publication on the website.
Legal Notices
The Customer who purchases products marketed by PHILIP MARTIN'S accepts that any dispute and relationship is subject to Italian law.
Product Features
The Customer purchases the product, whose characteristics are illustrated in the relevant descriptive and technical sheets, at the indicated price including VAT, plus any shipping costs specified on the website. Product images are for illustrative purposes only: depending on the software or other IT tools used by the Customer when connecting to the website, the product's color tones may not be displayed correctly. The Seller assumes no responsibility for any problems caused to the Customer by using the website and the technologies employed.
Purchase Procedure
The Customer is required to carefully read these general conditions before submitting their purchase order. Submitting a purchase order implies their full knowledge and acceptance. The "validation click" constitutes an electronic signature that has the same value between the parties as a handwritten signature.
Purchasing on the website www.philipmartins.it takes place via a simple guided process.
Receipt of the Customer's offer is confirmed by www.philipmartins.it via an automatic reply sent to the Customer's email address within 48 hours of receiving the purchase offer. This automatic email only confirms receipt of the offer, and the confirmation message will contain the Order Number to be used in all subsequent communications with PHILIP MARTIN'S. Orders will be accepted and processed during each business week (Monday to Friday), excluding holidays.
The Customer can view each order in their personal area of the website, where the details will be updated as soon as the order is processed. Each sales contract stipulated between PHILIP MARTIN'S and the Customer is deemed concluded upon acceptance of the order by PHILIP MARTIN'S. PHILIP MARTIN'S expressly reserves the right not to accept the order, and therefore not to finalize the sales contract, if there is insufficient guarantee of solvency of payment, if the orders submitted are incomplete or incorrect, or if the products are no longer available. In the cases listed above, the Seller will promptly inform the Customer via email that the order has not been confirmed and therefore the contract has not been concluded, specifying the reasons.
Prices, Delivery Times and Methods
All product prices include VAT and are clearly indicated on the individual product pages.
Prices are in any case subject to change at any time and without notice, it being understood that, limited to orders being accepted or already accepted by PHILIP MARTIN'S, the conditions of sale in force at the time the order is sent by the Customer will apply.
Items will be processed upon receipt of the order and will therefore be made available for shipment within 2-3 working days of acceptance of the order and payment.
Delivery of the purchased products will take place exclusively to the postal address specified by the Customer in the order form.
Deliveries will be made from Monday to Friday during normal office hours, excluding national holidays.
Upon delivery, the Customer must verify the contents, conformity, and condition of the products. If the package is severely damaged to the point that the contents may be damaged, the Customer may refuse delivery of the goods by indicating "I REFUSE THE GOODS DUE TO DAMAGED PACKAGING" on the courier's delivery note.
In any case, any complaint must be formally sent to desk@philipmartins.it within 72 hours of receiving the delivery, indicating the order number, the reason for the complaint, and attaching photographic material.
After 72 hours from receipt of delivery, the goods are considered fully accepted by the Customer and no claims can be made against the Seller.
Payments
Payment for purchased products can be made using the following methods:
- Credit card 
- PayPal 
Possible unavailability of the Product
The data indicated on the individual product sheets is not updated in real time, therefore in some sporadic situations it may happen that an ordered product is actually not available.
In any case, the customer will be informed of the exact shipping date within 48 hours of receiving the order.
If the item is unavailable, the Customer will receive an email with instructions on how to supply a similar item.
Under no circumstances will PHILIP MARTIN'S be held responsible for any delays in delivery.
Right of Withdrawal
Any Customer who, for any reason, is not satisfied with their purchase has the right to withdraw from the contract without penalty and without specifying the reason, within 10 working days of receiving the goods.
To exercise the right of withdrawal, the Customer must send a written communication by registered mail with acknowledgement of receipt to the following address: PHILIP MARTIN'S, with operational headquarters in Altavilla Vicentina (VI) in Via Brenta, 34.
In this communication, the Customer must also provide their IBAN code, correct and complete with all the details necessary for crediting the amount to be refunded.
Shipping costs for returning products are the responsibility of the Customer. Products must be returned intact and in their original packaging. If the Seller finds damage and/or breakages to the goods returned by the Customer, or if it determines that the withdrawal was exercised after 10 working days from receipt of the goods, the right of withdrawal cannot be exercised. The Seller will not refund the purchase price and will make the product available to the Customer, who may take it back at their own expense.
If all the conditions for a valid withdrawal are met, and the returned goods are found to be intact, the Seller will refund the price to the customer via bank transfer within 30 working days of receiving the goods.
Responsibility
In unforeseeable and entirely involuntary cases attributable to force majeure, such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to IT systems, system crashes, and other similar events, PHILIP MARTIN'S assumes no responsibility for any impediments to the execution of the contract, in whole or in part, within the agreed timeframe. Nor will it be liable for any damages, losses, and/or costs resulting from the above-mentioned events. The consumer is only entitled to a refund of the price paid. PHILIP MARTIN'S is also not responsible for any fraudulent or illicit use of credit cards, checks, or other means of payment, since it does not have access to the consumer's credit card number at any stage of the purchase process. This data is always transmitted directly to the bank managing the service via a secure connection.
User Responsibilities
PHILIP MARTIN'S assumes no responsibility for any damage/deterioration of the products resulting from non-compliant use and not in line with the instructions clearly indicated on the labels affixed to each product.
PHILIP MARTIN'S cannot be held liable for any direct or indirect damage caused by the downloading of images or elements from the www.philipmartins.it website, computer viruses, malfunctions, or errors that may hinder continued access to the website or cause difficulties in web browsing.
Applicable law and competent court
This contract is deemed to have been concluded in Italy, is subject to the jurisdiction of the Italian state, and is governed by Italian law. Any dispute relating to the stipulation, interpretation, execution, or termination of this contract shall be submitted to the exclusive jurisdiction of the Court of Vicenza.
Secure Payment
All payments available on PHILIP MARTIN'S are 100% secure. When using your credit card, your data will always travel on secure and encrypted servers.
Payment by Credit Card
PHILIP MARTIN'S uses the international payment system that accepts all major credit cards and prepaid cards. The customer's financial data will be managed directly by the BANK and will not be processed in any way by PHILIP MARTIN'S.
SHIPMENTS
Delivery
Orders placed during office hours (Monday to Friday, 9:00 AM to 1:00 PM) will be processed the same day. Deliveries are not made on Saturdays, Sundays, and holidays, and will be made on the next business day.
Delivery times are 2/3 working days.
Deliveries are made via GLS courier for deliveries in Italy and via DHL for deliveries abroad.
The cost of domestic shipping is covered by PHILIP MARTIN'S.
The shipping cost for customers in the EEC + Switzerland + Vatican City + Albania is €25.00.
If the courier's various delivery attempts and attempts to contact the customer are unsuccessful, the goods will be returned to PHILIP MARTIN'S and the amount paid by the customer will be retained.

PHILIP MARTIN'S reserves the right to refuse, suspend or cancel, at its sole discretion, delivery or the fulfillment of any of its obligations under the sales contract, in the event of alleged fraud, default or violation by the Customer of obligations assumed towards PHILIP MARTIN'S under previous orders and/or sales contracts.
Returns and Exchanges
Within 10 business days of receiving the purchased goods, any consumer who is dissatisfied with their purchase has the right to withdraw from the contract without penalty and without specifying the reason. They must therefore send us written notification by registered letter with acknowledgement of receipt or, as provided for by Article 5, No. 4 of Legislative Decree No. 185/1999, to:

Within the aforementioned 10-day period, all purchased products must be returned to the sender-supplier, under penalty of forfeiture of the right of withdrawal, under the following conditions:
- Returned goods must be perfectly intact and in their original packaging. 
- Applying labels or adhesive tape to the original product packaging or to the product itself is prohibited. 
- Until it arrives at the PHILIP MARTIN'S headquarters, the shipment is under the full responsibility of the customer. 
- The related shipping costs for returning the goods are the responsibility of the customer-consumer. 
PHILIP MARTIN'S will not be liable in any way for damage or theft/loss of products returned via uninsured shipments, nor will it under any circumstances collect packages paid for by cash on delivery or postage due.
If the consumer exercises the right of withdrawal in accordance with the above, the supplier will refund the sums already paid, excluding any repair costs for damage found to the original packaging, no later than 30 days from the date of receipt of the written communication and the goods by the consumer by reversing the amount charged for the purchase of the goods (therefore excluding shipping costs) to the credit card or by bank transfer (in this case the customer will take care to provide his/her bank details).
