The general conditions of sale apply to any order placed on the sitewww.philipmartins.it.

The Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general and payment conditions; others claim to be of legal age and in any case the legal capacity and to enter into a valid and effective sales contract.

PHILIP MARTIN'S may modify, at any time and without notice, the content of the

GENERAL CONDITIONS referred to in this document; these changes will take effect from the date of publication on the site.

The customer who purchases products marketed by PHILIP MARTIN's accepts that any dispute and relationship is subject to Italian law.

Products Characteristics

The Customer purchases the product, the characteristics of which are illustrated in the relative descriptive and technical sheets, at the price indicated therein plus any shipping costs specified on the site. The images of the products are illustrative: depending on the software or other IT tools used by the Customer when connecting to the site, the color tones of the

product may not be displayed correctly. The Seller assumes no responsibility for problems caused to the customer by the use of the site and the technologies used.

Purchase procedure

The Customer is required, before submitting his or her purchase order, to carefully read these general conditions. The forwarding of the purchase order implies their full knowledge and acceptance. The "validation click" constitutes an electronic signature that has the same value between the parties as a handwritten signature.

Purchasing on the site www.philipmartins.it,

takes place through a simple guided path.

Correct receipt of the Customer's proposal is confirmed by www.philipmartins.it through an automatic reply sent to the Customer's email address, within 48 hours of receipt of the purchase proposal. This automatic email only confirms the correct receipt of the proposal and the confirmation message will contain the Order Number to be used in any subsequent communication with PHILIP MARTIN'S. Orders will be accepted and processed within each working week (Mon / Fri) net of holidays.

The Customer will be able to view each order in their personal area of ​​the site whose data will be updated as soon as the order is processed. Each sales contract stipulated between PHILIP MARTIN'S and the Customer is considered concluded with the acceptance of the order by PHILIP MARTIN'S which expressly reserves the right not to accept the order, and therefore not to complete the sales contract, if there are insufficient guarantees of payment solvency or if the orders transmitted are incomplete or incorrect or if the products are no longer available. In the cases just listed, the Seller will promptly inform via e-mail that he has not confirmed the order and that therefore the contract has not been concluded, specifying the reasons.

Prices, Timing and Delivery Methods

All product prices are inclusive of VAT and clearly indicated in the individual sheets.

The prices are in any case subject to change, at any time and without notice, it being understood that limited to orders being accepted or already accepted by PHILIP MARTIN'S, the conditions of sale in force at the time the order is sent will apply. part of the Customer.

The artifacts will be processed upon receipt of the order and therefore they will be made available for shipment within 2/3 working days from acceptance of the order and payment.

The delivery of the purchased products can only take place at the postal address specified by the Customer in the order form.

Deliveries will be made from Monday to Friday during normal office hours, excluding national holidays.

Upon delivery, the Customer must check the content, compliance and status of the products. If the package is seriously damaged to the point that a consequent damage to the contents can also be assumed, the Customer may refuse delivery of the goods by indicating on the courier's transport document the words "I REFUSE THE GOODS FOR DAMAGED PACKAGING".

Any complaint must in any case be formally transmitted to desk@philipmartins.it 

no later than the maximum term of 72 hours from receipt of delivery, indicating the order number, the reason for the complaint and accompanying the same with photographic material.

After 72 hours from taking charge of the delivery, the goods are understood as fully accepted by the Customer and nothing can be claimed from the Seller.

The payment of the purchased products can be made in the following way:

Possible Product Unavailability

The data indicated in the individual product sheets are not updated in real time therefore in some sporadic situations it could happen that an ordered product is not actually available.

The customer will in any case be informed, within 48 hours of receiving the order, of the exact shipping date.

In case of unavailability of the item, the Customer will be sent an email with an indication for the supply of a similar item.

In no case can PHILIP MARTIN'S be held responsible for any delays in delivery.

Right of Withdrawal

The Customer who for any reason is not satisfied with the purchase made, has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 10 working days from the day of receipt of the goods.

To exercise the right of withdrawal, the Customer must send a written communication by registered letter with acknowledgment of receipt to the following address: PHILIP MARTIN'S, with operational headquarters in Altavilla Vicentina (VI) in Via Brenta, 34.

In this communication, the Customer must also communicate their IBAN code, correct and complete with every detail necessary for the credit of the amount to be refunded.

The shipping costs for returning the products are charged to the customer. The products must be returned intact and in their original packaging. If the Seller finds damage and / or breakages of the goods returned by the Customer, or if he verifies that the withdrawal has been exercised after 10 working days from receipt of the goods, the right of withdrawal cannot be exercised, the Seller will not refund the purchase price and will make the product available to the Customer, who can take it back at his own expense and care.

If all the conditions for a valid withdrawal are met, and the returned goods are found to be intact, the Seller will refund the price to the customer by bank transfer within 30 working days of receipt of the goods.

Responsibility

In unforeseeable and completely involuntary cases attributable to force majeure such as: accidents, explosions, fires, riots, strikes and / or lockouts, earthquakes, floods, damage to computer systems, system failures, and other similar events, PHILIP MARTIN'S assumes no responsibility for any impediments to executing the contract, in whole or in part, within the agreed time, nor will it be liable for any damages, losses and / or costs deriving from the events listed above, having the consumer is only entitled to a refund of the price paid. PHILIP MARTIN'S is also not responsible for any fraudulent or illegal use of credit cards, checks and other means of payment, since at no stage of the purchase procedure can it know the consumer's credit card number. In fact, these data are always transmitted directly to the Bank managing the service via a secure connection.

Users Responsibility

The PHILIP MARTIN'S Company assumes no responsibility for any damage / deterioration of the products resulting from non-compliant use and not in line with the indications clearly affixed to the labels affixed to each product.

Even in cases of any direct or indirect damage caused by downloading images, or elements on the site www.philipmartins.it, of computer viruses, malfunctions and errors, which could hinder the continuity of access to the site or cause difficulties in web browsing, PHILIP MARTIN’S can never be held responsible.

Applicable Law and Jurisdiction

This contract is intended in any case concluded in Italy, is subject to the jurisdiction of the Italian state and is governed by Italian law. Any dispute relating to the stipulation, interpretation, execution or termination of this contract will be referred to the exclusive jurisdiction of the Vicenza court.

All payments available on PHILIP MARTIN'S are 100% secure. By using your credit card, your data will always travel on secure and encrypted servers.

Payment by credit cards

PHILIP MARTIN'S relies on the international payment circuit that accepts all major credit cards and existing prepaid cards. The customer's financial data will be managed directly by the BANK and will not be processed in any way by PHILIP MARTIN'S.

SHIPPING FEES

Delivery

Orders placed during office hours (Monday to Friday, from 9:00 to 13:00) will be processed on the same day. Deliveries are not made on Saturdays and Sundays and on holidays, therefore they are made on the next working day.

Delivery times are 2/3 working days.

Deliveries are made by BRT Bartolini courier for deliveries in Italy and with DHL for deliveries abroad.

The cost of national shipping is borne by PHILIP MARTIN'S.

The cost of shipping for CEE + Switzerland + Vatican City + Albania customers is € 25.00.

The cost of shipping for REST OF THE WORLD customers is € 50.00.

If the various delivery and contact attempts of the courier to the customer are unsuccessful, the goods will be taken back by PHILIP MARTIN'S and the amount paid by the customer will be retained.

Returns and Exchanges

Within 10 working days from the day of receipt of the purchased goods, the consumer who is not satisfied with the purchase made, has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason. You will therefore have to send us a written communication by registered letter with acknowledgment of receipt or also, as required by art. 5 n. 4 of Legislative Decree n ° 185/1999 to:

Within the aforementioned term of 10 days, all purchased products must be returned to the sender-supplier, under penalty of forfeiture of the right of withdrawal, under the following conditions:

  • The returned goods must be perfectly intact and in their original packaging.

  • The application of labels or adhesive tapes on the original product packaging or on the product itself is prohibited.

  • Until arrival at the PHILIP MARTIN'S headquarters, the shipment is under the full responsibility of the customer.

  • The relative transport costs for the return of the goods are charged to the customer-consumer.

PHILIP MARTIN'S will not be liable in any way for damage or theft / loss of products returned by uninsured shipments nor will in any case collect parcels on delivery or carriage forward.

If the consumer exercises the right of withdrawal in accordance with the above, the supplier will refund the sums already paid, without prejudice to any restoration costs for damage to the original packaging, no later than 30 days from the date of receipt of the written communication and goods by the consumer through the transfer procedure of the amount charged for the purchase of the goods (therefore excluding shipping costs) on the credit card or by bank transfer (in this case the customer will take care to communicate his bank details) .
